Love it or Bring It Back Program – Detailed Terms and Conditions

Welcome to the “Love it or Bring It Back” Program offered exclusively by Kings Auto Ltd. These terms and conditions govern the participation in the Program and outline the rights and responsibilities of all customers who wish to take part.

Program Overview

The “Love it or Bring It Back” Program allows eligible customers to return their vehicle to Kings Auto Ltd within a specified period if they are not satisfied, under the terms detailed below.

1.1 Return Period: Customers can return the vehicle within 90 days from the date of purchase, or within a maximum of 3,000 kilometers, whichever comes first. 1.2 Purchase Requirements: To qualify for the Program, customers must meet specific conditions regarding vehicle financing and the purchase of add-ons as outlined in Section 2.

1.3 Program Exclusions: The Program is not available for cash purchases or lease agreements, and is exclusively for customers financing their vehicle through Kings Auto Ltd’s partnered lenders.

Eligibility Criteria

2.1 Financing Requirement:

The Program is only available for vehicles that are financed through Kings Auto Ltd’s partnered banks or lenders.
Customers must complete a financing agreement for the original vehicle and obtain financing approval for a replacement vehicle if they wish to return the original car.
If the customer fails to receive financing approval on another vehicle at the time of return, the return process will be delayed until approval is obtained.

2.2 Warranty and GAP Protection Purchases:

To be eligible for the Program, customers must purchase a Powertrain Plus 12 months/20,000 KM $2,500 per claim warranty for $2,490 or any higher-tier warranty package, along with Financial GAP protection Add-On for $1,990.
For electric, hybrid, or luxury vehicles, the customer must purchase the Premium 5-Star Hi-Tech 12 months/25,000 KM warranty for $3,490 along with the Financial GAP protection Add-On for $1,290.
These warranties and protection plans are provided by Kings Auto Ltd’s trusted third-party partner, Gurantee VC.
No warranty or GAP protection purchases are refundable under the Program, even if the customer decides to return the vehicle.

2.3 Condition of Return:

The vehicle must be returned in the same condition as when it was originally delivered, without any new damages, mechanical issues, or excessive wear and tear.
The maximum mileage allowed is 1,000 kilometers per month, for a total of 3,000 kilometers within the 90-day return period.
If the vehicle exceeds 3,000 kilometers, the return price will be reduced by $1 for every additional kilometer driven beyond this limit.

Return Conditions and Vehicle Inspection

3.1 Return Condition:

The vehicle must be returned to Kings Auto Ltd in its original condition, as documented at the time of purchase.
An inspection will be conducted upon return to assess the vehicle’s condition, including exterior, interior, and mechanical components.

3.2 Deductions for Damages:

Any damage or defect not present at the time of delivery will result in a deduction from the return price, based on the cost of necessary repairs.
The customer will be responsible for repair costs for any of the following:

○ Scratches, dents, or damage to the bodywork.

○ Wear and tear beyond normal use.

○ Mechanical or electrical issues caused by improper use or negligence. ○ Missing accessories, components, or documents.

3.3 Accidents and Claims:

If the vehicle has been involved in any accidents or if any insurance claims have been made during the 90-day period, Kings Auto Ltd reserves the right to: ○ Refuse the return altogether, or

○ Deduct an appropriate amount from the return price based on the diminished value of the vehicle due to the accident or insurance claim.

Non-Refundable Fees and Add-Ons

4.1 Non-Refundable Fees:

Any additional purchases made in connection with the vehicle, such as warranties, GAP protection, service packages, accessories, or other add-ons, are non-refundable under the Program.
The only amount eligible for refund is the purchase price of the vehicle, subject to any deductions for damages, excess kilometers, accidents, or claims.

4.2 Deduction Process:

If any of the above conditions are breached, Kings Auto Ltd will conduct an evaluation to determine the extent of the damage or issue.
Kings Auto Ltd reserves the right to determine the appropriate amount to be deducted from the return price based on these factors.

Eligibility and Contract Requirement

To be eligible for the “Love it or Bring It Back” Program, customers must sign the official program contract at the time of vehicle purchase.
The Program start date is October 1st, 2024. Any purchases made before this date are ineligible for participation.
By signing the contract, the customer acknowledges their acceptance of these terms and conditions.

Governing Law

These terms and conditions are governed by and interpreted in accordance with the laws of the Province of Ontario.
